(一)自费留学中介服务机构必须是获得资格认定，并已领取营业执照的中介服务机构。
(二)自费留学中介服务机构必须在所在的省、自治区、直辖市行政区域内开展中介服务业务；跨地区开展 中介服务业务的，应当报经教育部和公安部另行审批，并凭《自费出国留学中介服务机构资格认定书》和有关的批准文件，向相关的省、自治区、直辖市教育行政部门和公安机关出入境管理部门备案。
(三)中介服务机构不得在所在省、自治区、直辖市行政区域外设立分支机构，不得以承包或者转包等形式委托其他机构或个人开展中介服务业务。
(四)中介服务机构不得到学校开展自费出国留学咨询、讲座、座谈会、介绍会等任何形式的自费出国留学招生活动。
(五)中介服务机构必须根据《中华人民共和国合同法》与其服务对象签署具有法律效力的《自费出国留学中介服务协议书》，明确双方的权利与义务。《自费出国留学中介服务协议书》的样本应当报当地省、自治区、直辖市教育行政部门备案。
(六)中介服务机构应必须在破产、解散、停业60日前，以书面形式向当地省、自治区、直辖市教育行政部门提出终止中介服务申请(应包括处理善后事宜的措施、期限和留守人员名单)，并缴还《自费出国留学中介服务机构资格认定书》；经教育部、公安部核准后，向原办理企业登记注册的工商行政管理部门申请注销；并向当地省、自治区、直辖市公安机关出入境管理部门备案。 | |
